JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Kanti P.S.Case No. 502 of 2014 registered for the offences punishable under Sections 376 of the I.P.C. but later on Section 4/6 of POCSO Act has been added. The accusation is of committing rape upon the victim girl, Khushbu Kumari, is about 15 years. Learned counsel for the petitioner submits that the entire story is malicious and false and there is old enmity between the both families since long back with regard to purchase of piece of land by the father of the petitioner.

Patna High Court Cr.Misc. No.9529 of 2016 (2) dt.11-04-2016 2/2 Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, above named, I am not inclined to grant anticipatory bail to the petitioner. Accordingly,, the prayer of the bail of petitioner stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the Trial Court in accordance with law without being prejudiced by the order of this Court.
