The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 392 of the Indian Penal Code and 3⁄4 of the Explosive Substances Act. Prosecution case is that Rs.6,64,855/- was robbed from the electricity department at Banka when the FIR was registered against unknown. Subsequently, the name of the petitioner sprang up during investigation.

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner. Moreover, coaccused person have been granted regular bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous Nos.46741/2014, 48450/2014 and 47571/2014.

Patna High Court Cr.Misc. No.9228 of 2016 (2) dt.29-02-2016 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Banka P.S. Case No.305/2014, pending before the learned CJM, Banka . With the above observation, this application is, accordingly, disposed off.
