JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under sections 341, 342, 323, 324, 307, 379, 34 of the Indian Penal Code. It is alleged by the informant that the accused persons assaulted his son Neeraj Kumar.
It appears from perusal of the First Information Report that Neeraj Kumar stated that this petitioner pointing pistol on his head asked other accused persons to assault him, whereupon Raj Kamal hurled farsa blow on his head causing injuries. Learned counsel for the petitioner submits that the injuries caused on Neeraj Kumar are simple in nature. Further more, no case under the Arms Act has been registered.
It appears that the allegation of hurling farsa blow on the head of Neeraj Kumar is against accused Raj Kamal.
Patna High Court Cr.Misc. No.8488 of 2016 (2) dt.11-04-2016 Considering the facts and circumstances of the case, the petitioner Nabodh Yadav @ Navod Yadav, is directed to be released on anticipatory bail, in the event of his arrest/surrender, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Kasim Bazar P.S. Case No.206 of 2015, subject to the conditions that he will not absent himself in the court below for two consecutive dates at a stretch till two witnesses are examined in trial. He will also appear in the local Police Station once in every month and would file an affidavit to this effect in the Court below, failure of which would invite cancellation of bail.
