2. It is a common ground at the Bar that necessary orders for payment of the admitted retrial benefits of the petitioner have been issued. However, learned counsel for the petitioner submitted that payment of earned leave has not been made or finalized.

3. Learned counsel for the State submitted that the authorities have found 44 days of earned leave to be payable and, accordingly, authority has also been issued. It was submitted that if, for any reason, actual payment has not been made, the same shall also be made.

In view thereof, the writ petition stands disposed off with a direction to respondent no. 4 to ensure that actual payment relating to encashment of unutilized leave is made to the petitioner, if already not done, within three weeks from the date of production of a copy of the order before him. Further, the petitioner shall be at liberty to file representation before the concerned authority with regard to any of his remaining grievance. If the same is filed within three weeks from today, the authority shall look into the matter and pass appropriate order within three weeks thereafter. If the authority comes to the conclusion that any payment is to be made to the petitioner, the same shall also be paid to the petitioner within the next three weeks. (Ahsanuddin Amanullah, J) SA/- U √
