JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Sonbarsa P.S.Case No. 81 of 2021 for the offences punishable under Sections , 8/20(b), (B) of the N.D.P.S Act.

It is a case of recovery of 5.800 K.G Ganja from the house of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Neither petitioner was caught on the spot nor the alleged Ganja was recovered from possession of the petitioner.

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Patna High Court CR. MISC. No.46067 of 2021(2) dt.24-03-2022 2/2 Considering the facts, I am not inclined to enlarge the petitioner on anticipatory bail and hence, his prayer for anticipatory bail stands rejected.

Petitioner is directed to surrender before the court below and seek regular bail.
