The petitioner is languishing in custody since 10.02.2019 in a case registered for the offence punishable under Section 414 of the Indian Penal Code.

It is alleged that the petitioner along with co-accused Manish Kumar Thakur was apprehended with a stolen motorcycle.

It is submitted by learned counsel for the petitioner that the specific accusation has not been alleged against the petitioner and co-accused Manish Kumar Thakur has been granted bail by the learned Court below. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court CR. MISC. No.34333 of 2019(2) dt.27-05-2019 2/2 Learned APP submits that the stolen motorcycle has been recovered from the possession of the petitioner. Considering the fact that the investigation has already been concluded and the similarly situated co-accused Manish Kumar Thakur has been granted bail by the learned Court below, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kankarbagh P.S. Case No. 158 of 2019.
