JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-01-2021 The present petition has been filed qua the petitioner herein for modifying the order dated 08.07.2020 passed in Criminal Misc. No. 21193 of 2020 to the extent that the time granted to the petitioner, be extended by a further period of two weeks from today.

The learned counsel for the petitioner has submitted that the petitioner has approached the learned court of Judicial Magistrate-1st Class, East Champaran, Motihari in connection with Compliant Case No. C-1673 of 2019 in order to surrender, however, since the Court was closed on account of COVID-19 pandemic, he could not enter the Court premises resulting in expiry of the time period granted to him to surrender.

No.7794 of 2021(2) dt.29-01-2021 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to extend the time period granted to the petitioner to surrender before the learned court of Judicial Magistrate-1st class, East Champaran, Motihari in connection with Compliant Case No. C-1673 of 2019, by a further period of two weeks from today.

Accordingly, the order dated 08.07.2020 passed in Criminal Misc. No. 21193 of 2020 stands modified. The petition stands allowed.
