The petitioner seeks bail in connection with Sugauli P.S. Case No.455 of 2014 registered under Sections 323, 354, 379, 363/34 and, later on, added Section 366 of the Indian Penal Code and Section 12 of POCSO Act, 2012.

The accusation against the petitioner is that he alongwith one another co-accused took Rubana Khatoon, the minor daughter of the informant, and when Najma Tara, the elder daughter of the informant, rushed to save her sister then she was also forcibly taken on motorcycle by them but on raising voice, both the daughters of the informant were left by them.

No.55324 of 2015 (3) dt.03-02-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is the next door neighbour of the informant and due to land dispute, he has falsely been implicated in this case. Moreover, the petitioner has no criminal antecedent and is in custody since 03.09.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Motihari, East Champaran, in connection with Sugauli P.S. Case No.455 of 2014. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
