The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 323, 324, 504 and 506 of the Indian Penal Code.

As per the prosecution case, the petitioner is said to have given a blow on the informant with a spade (kudal) causing grievous injury on his head and on his right hand. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. From perusal of the FIR itself it would transpire that the dispute was over a trivial matter. The petitioner was not carrying any weapon. There is no repetition of blow. The petitioner is in custody since 3.4.2021 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts of the case and the petitioner having remained in custody for 11 months, the petitioner is directed to be enlarged on bail in connection with Buxar (I) P.S. Case no. 110 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st - cum - Special Judge (SC/ST) Buxar.
