JUSTICE RAJESH KUMAR VERMA ORAL ORDER 01-08-2025 Heard Mr. Bipin Kumar, learned counsel for the petitioner, Ms. Asha Devi, learned Additional Public Prosecutor for the State and Mr. Ajay Kumar Sinha, learned counsel for the informant.
2. Petitioner seeks bail who is in custody since 24.03.2025 in connection with Barbigha P.S. Case No. 91 of 2024, F.I.R. dated 26.03.2024 for the offences punishable under Sections 302/34 of the IPC.
3. According to prosecution case, due to nonfulfillment of demand of dowry, the petitioner along with other co-accused persons is said to have tortured and killed the daughter of the informant.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.39396 of 2025(3) dt.01-08-2025 2/3 petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R. In fact, the deceased has committed suicide herself and on the date of occurrence, he was not present at the place of occurrence, he was in Rajasthan. It is further submitted that coaccused persons, who were family members of this petitioner, were granted privilege of anticipatory bail by this Court vide order dated 29.01.2025 passed in Cr. Misc. No. 72718 of 2024. The petitioner is in custody since 24.03.2025.

The learned Additional Public Prosecutor for the State and learned counsel for the informant, on the other hand, on the basis of the materials available on record and the case diary, have vehemently opposed the prayer for bail of the petitioner and submits that it has come during investigation that on the date of occurrence, the petitioner was present at the place of occurrence and in paragraph-6 of the case diary in which the statement of the daughter of the victim, who was also the daughter of the petitioner was recorded in which she has stated that the petitioner along with other co-accused persons has committed the present crime in question.

6. Considering the aforesaid fact, I am not inclined to enlarge the petitioner on bail in connection with Barbigha P.S. Case No. 91 of 2024 pending in the court of learned C.J.M., Sheikhpura.
7. Prayer is refused.
