The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,341,323,307,448,504,379,436 and 427 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that the petitioner assaulted Prabhat Kumar Sharma with garasa causing cut injury on the head. Other accused persons assaulted Pankaj Kumar and Ram Nagina Sharma. The petitioner and co accused Pankaj Thakur are alleged to have set ablaze the hut of Pramila Devi.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.8854 of 2016 (2) dt.25-02-2016 2/2 petitioner that injury has been found to be simple and there is no accusation of repeating the blow. It is further submitted that at earlier point of time the petitioner side filed informatory petition and there is counter version of the occurrence also. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Sakara P.S. Case No. 217 of 2014 pending in the court of learned CJM, Muzaffarpur. This application is disposed of with the aforesaid observation/direction.
