The petitioner seeks modification of the order dated 31.03.2022 passed in Cr. Misc. No. 17413 of 2021 wherein the petitioner was granted bail subject to a condition that he will deposit Rs. 30,000/- in one installment under the protest and subject to his right and contentions later.
The learned counsel for the petitioner has submitted that due to lack of money as well as miscommunication, he could not surrender within the stipulated time before the court below to take advantage of the order.
For the reasons stated in the application, the prayer for extension of time for surrendering of the petitioner before the
Patna High Court CR. MISC. No.38107 of 2022(2) dt.27-07-2022 2/2 court below is allowed.
The order dated 31.03.2022 is modified to the extent that if the petitioner, above named, surrenders before the learned court below within a period of four weeks from today, he will be accorded the privilege under the order dated 31.03.2022 on the same terms and conditions.
With the aforesaid modification, the application stands allowed.
