Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Kurtha P.S. Case No. 182 of 2019 for the offence punishable under Sections 302, 120-B/34 of the Indian Penal Code. As per the F.I.R., Balmiki Sharma was killed by the petitioner and others by stabbing him.

In view of the law laid down by the Apex Court in the case of Jai Prakash Singh vs. State of Bihar & Anr. reported in (2012) 4 SCC 379, I am not inclined to grant anticipatory bail to the petitioner as he has actively participated in the crime.
