In this case, the petitioner is apprehending his arrest in connection with Ujiyapur P.S. Case No. 96 of 2015 for offence under Sections 448, 341, 323, 324, 307, 354, 504, 506/34 of the Indian Penal Code.

As per allegation made in the First Information Report, the petitioner had caught hold the victim lady and from the backside, co-accused Dinesh Ram has caused serious injury on her head.

Learned counsel for the petitioner submits that coaccused Dinesh Ram has been granted regular bail whereas Sheela Devi, wife of the co-accused, has also been granted anticipatory

Patna High Court Cr.Misc. No.10063 of 2016 (2) dt.08-03-2016 bail.

There is direct allegation against the petitioner who has caught hold the victim lady whereupon Dinesh Ram has caused injury on her head. This Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, namely, Dilip Ram is rejected.

If the petitioner surrenders before the court below within a period of four weeks from today, the court below will pass order on the date of surrender without being prejudiced by this order. The court below shall also consider the fact regarding grant of bail to Dinesh Ram.
