JUSTICE PRABHAT KUMAR JHA ORAL ORDER 10-05-2016 Heard Shri Vikram Deo Singh, learned counsel for the petitioner and the learned APP for the State. The petitioner apprehends his arrest in Pandaul P.S. Case No. 149 of 2000, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that, of course, the petitioner is named, but during course of investigation the Dy. S.P. did not find the involvement of the petitioner and after twelve years the S.P. directed to arrest the petitioner. It has further been submitted that initially the name of the petitioner was mentioned, but his parentage was wrong. It has come that the parentage of the petitioner has wrongly been mentioned at the earlier stage.

No.9090 of 2016 (3) dt.10-05-2016 2/2 Considering the facts aforesaid and the fact that many witnesses have stated name of the petitioner and it has come that it was the petitioner who was also involved in the case but his parentage was wrongly mentioned, I am not inclined to enlarge the petitioner above named on anticipatory bail in Pandaul P.S. Case No. 149 of 2000, pending in the court of the learned Chief Judicial Magistrate, Madhubani. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) KKSINHA/- U T
