The petitioner, who is in custody since 06.08.2017, seeks bail in connection with Thawe P.S. Case No. 124 of 2017, dated 05.08.2017, instituted for the offences under Sections 302 and 34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by a Bench of this Court.

On 22.12.2020, this Court had called for a report

Patna High Court CR. MISC. No.34595 of 2020(3) dt.08-02-2021 2/2 from the Court below about the stage of the case, which report has been received. The report indicates that out of nine prosecution witnesses, seven have already been examined.

In view of the report referred to above, it appears that there is every likelihood of the trial being concluded in near future.

Considering the present stage of the trial, which is almost at the fag end, I am not inclined to grant bail to the petitioner.

The prayer for grant of bail is, accordingly, rejected.

The Trial Court, however, is directed to conclude the trial positively within a period of six months from the date of receipt/production of a copy of this order. The application stands disposed off accordingly. (Ashutosh Kumar, J) Praveen-II/- U T
