Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Rajepur P.S. Case No. 29 of 2020 lodged under Sections 341, 323, 307, 379, 504, 34 of the I.P.C.
As per the prosecution case, the alleged occurrence took place. On the point of running vulgar bhojpuri song on D.J., the petitioner is alleged to be the order given. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 22.03.2022 having one criminal antecedent in which he is on bail. He submits that
Patna High Court CR. MISC. No.37405 of 2022(2) dt.22-09-2022 2/2 this Court has granted bail to one accused in this case vide order dated 21.09.2022 passed in Cr. Misc. No. 36783 of 2022. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Motihari, East Champaran in connection with Rajepur P.S. Case No. 29 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
