In the present case, the petitioner is seeking bail in connection with Hathauri P.S. Case No. 134 of 2009 for offence under Sections 304(B), 201, 120(B)/34 of the Indian Penal Code. Allegation has been made against the accused persons of demanding dowry and have killed the victim by burning. From the First Information Report itself it is clear that the Informant has died at Delhi and her body was brought in village Hathauri, Muzaffarpur.
Learned counsel for the petitioner submits that it does not stand to reason that the petitioner would bring the dead body of the victim from Delhi to Muzaffarpur and the same could have
Patna High Court Cr.Misc. No.57162 of 2015 (3) dt.19-02-2016 been disposed of there itself without any information to the Informant.
Looking to the nature of allegation and attending circumstances, let the petitioner, namely, Rajesh Singh be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Hathauri P.S. Case No. 134 of 2009.
