Petitioner is languishing in custody since 27.08.2013 has renewed his prayer for bail in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code. The prosecution case is that the informant was assaulted by the petitioner Vijay Yadav and co-accused Uday Yadav and Ravi Yadav, causing injury on the head, left arm and other parts of the body. Subsequently, informant succumbed to the injuries.

It is submitted by the learned counsel for the petitioner that from accusation it does not appear as who assaulted the informant.

Patna High Court Cr.Misc. No.56754 of 2015 (6) dt.14-09-2016 It is submitted by the learned counsel for the informant that all the prosecution witnesses have already been examined and evidence of prosecution is closed. Considering the present stage of trial, this Court is not inclined to grant bail to the petitioner. Accordingly, the bail application is dismissed.

However, it is expected from the learned court below to conclude the trial preferably within a period of three months.
