Admittedly, the entire outstanding amount of retiral dues of the petitioner has stood paid, however the learned counsel for the petitioner submits that the pension is required to be revised on the basis of 5th & 6th Pay Revision Committee Recommendations.

Accordingly, the present writ petition stands disposed off with a direction to the respondents to revise the pensionary benefits of the petitioner on the basis of 5th & 6th Pay Revision Committee Recommendations, if not already done. 3.

At this juncture, the learned counsel for the petitioner has pointed out that the respondent- State has filed a counter affidavit, wherein it has been stated that the State

Patna High Court CWJC No.12423 of 2018 dt.18-11-2019 2/2 Government has already disbursed the amount to the Nagar Parishad for the purposes of payment of the pensionary benefits and the arrears thereof, in accordance with the recommendation of the 5th & 6th Pay Revision Committee Recommendations, hence a direction be issued to make payment of the outstanding amount forthwith.

Accordingly, the respondent- Executive officer, Nagar Parishad, Madhubani is directed to pay the outstanding amount of the retiral dues of the petitioner within a period of four weeks from today, failing which the Executive officer, Nagar Parishad, Madhubani shall not draw his salary. 5.

The present writ petition stands disposed off on the aforesaid terms.
