JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-06-2019 Heard learned counsel for the petitioner and the State. The grievance of the petitioner is inaction on the part of the Circle Officer, Aurangabad in the matter of removal of encroachment over the public land.

Considering the nature of grievance raised by the petitioner in the instant case, the writ application is disposed of with a direction to the petitioner to approach the Circle Officer, Aurangabad along with a copy of this order.

In the event, an application is filed by the petitioner

Patna High Court CWJC No.11276 of 2019(2) dt.17-06-2019 2/2 before the Circle Officer, Aurangabad for registering a regular case for removal of encroachment under the provisions of Bihar Public Land Encroachment Act, the Circle Officer, Aurangabd is required to resister a regular case and after following the procedure under the said Act pass appropriate order with regard to removal of encroachment over the public land. Necessary decision in this regard may be taken by the Circle Officer, Aurangabad within a period of six months from the date of filing of application along with a copy of this order. It is made clear that the Circle Officer, Aurangabad is under obligation to see that no construction is being made over the public land.
