JUSTICE KHATIM REZA ORAL ORDER 02-08-2023 Mr. Kanishk Kaustubh, learned counsel appears and submits that he has been instructed by Mr. Ranjeet Kumar, learned advocate on record, to withdraw this appeal on account of its pecuniary jurisdiction.
2. Learned counsel for the appellant submits that the suit value is Rs. 40,000/-. Therefore, the appeal would lie before the District Judge. Accordingly, he prays that the memo of appeal be returned to file it before the appropriate forum.
3. Under the circumstances, office is directed to return the memo of appeal along with certified copy of the judgment to the advocate on record for filing the same before appropriate forum.
