JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 353, 337, 504, 283, 290, 431 and 432 of the Indian Penal Code.

The prosecution case is that on 31.07.2015 the informant being S.H.O., of Sahebpur Kamal police station received information that N.H.-31 has been blocked by the villagers in protest of crushing of five years old child and when the police tried to pacify the mob, stones were pelted. It is submitted by learned counsel for the petitioners that

Patna High Court Cr.Misc. No.9294 of 2016 (2) dt.01-03-2016 2/2 five years old son of petitioner no.4 was crushed by a tractor and mob was protesting against inaction of the police, hence the police in order to save own skin, lodged the present case. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in connection with S. Kamal P.S. Case No. 318 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
