NILU AGRAWAL ORAL ORDER 15-03-2019 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of the Union of India. Petitioner's husband Bhubaneshwar Singh was enrolled in the Army on 31.05.1991 and went missing from 05.07.1989. She has prayed for payment of arrears of family pension and other dues which the late employee was entitled. Learned counsel for the petitioner has filed I.A.No.01 of 2019 stating therein that at Annexure-R-5 dated 19.12.2018 the Senior Record Officer for OIC records, Respondent No.4 has called for the details of documents so that the family pension in her favour could be processed, sanctioned and paid.

Patna High Court CWJC No.15598 of 2017(3) dt.15-03-2019 2/2 Considering the statement made in the I.A.No.01 of 2019, the same is allowed. The respondent no.2 The Principal Controller of Defence Accounts (Pension) Allahabad is directed to take into consideration the letter dated 19.12.2018 issued by The Senior Record Officer, OIC Records, Sikandarabad, respondent no.4 and process, sanction and make payment of the entire retiral benefits including the pension, family pension with admissible interest to the petitioner within a period of three months from the date of receipt/production of the copy of this order.

Writ application is disposed of accordingly.
