The petitioner seek bail in S.T.185 of 2014 arising out of Gamharia P.S. Case No.80 of 2014 instituted for the offences under Sections 460, 323, 324, 307 and 302/34 of the Indian Penal Code.

This Court has already rejected the bail of the petitioner vide Cr. Misc. No.44372 of 2014.

From the report of the Additional Sessions Judge, Madhepura it appears that four witnesses have already been examined, only two witnesses i.e. Doctor and Investigating Officer are to be examined.

Looking to the nature of allegation, this Court is not

Patna High Court Cr.Misc. No.57266 of 2015 (3) dt.09-02-2016 inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected at this stage. However, the trial court is directed to conclude the trial within a period of six months from the date of receipt/production of a copy of this order. The trial court is also directed to take all possible steps for recovery of the witnesses.
