JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 20(b), 22, 23 and 24 of the NDPS Act.
On secret information, one person travelling on motorcycle was intercepted who disclosed his name as Suresh Prasad from whom 5 kg of Ganja were recovered. The apprehended accused confessed that he had to reach the seized contraband to this petitioner.
It is submitted by learned counsel for the petitioner that the petitioner was on inimical terms with alleged co-accused Suresh Prasad as he put the animal of Suresh Prasad in cattle house prior to the lodging of the present case. Considering the fact that recovery has not been made from the petitioner, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge-cum-Special Judge NDPS, Act East Champaran, Motihari in connection with NDPS P.S. Case No.57 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
