Heard learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the State through Video Conferencing.

This application has been filed for modification of order dated 09.04.2021 passed in Criminal Misc. No. 35613 of 2020.

Learned counsel for the petitioner submits that vide order dated 09.04.2021 passed in Criminal Misc. No. 35613 of

Patna High Court CR. MISC. No.46297 of 2021(2) dt.18-08-2021 2/2 2020, the petitioner was ordered to be released on bail in the event of arrest and surrender before the court below within a period of six weeks in connection with Deoriya P.S. Case No. 51 of 2019, pending in the court of J.M. Ist Class, Muzaffarpur (West), but due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated time.

In view of the above submission, the period of surrender of petitioner is extended for six weeks from today. The order dated 09.04.2021 passed in Criminal Misc. No. 35613 of 2020 is modified to the said extent.
