JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2022 Heard Mr. Yogesh Chandra Verma, learned senior Advocate for the petitioner and Mr. Ram Bilash Roy Raman, learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Majhaulia P.S. Case No. 08 of 2021 dated 05.01.2021 instituted for the offences under Sections 394 of the Indian Penal Code and Section 27 of the Arms Act.
Though the petitioner is named in the F.I.R. but the Informant claims to have learnt his name from people who had collected there shortly after the occurrence. The learned counsel for the petitioner has however pointed out that despite the petitioner remaining in custody since 16.01.2021, he has not yet been put to T.I.P. Nothing incriminating also has been recovered from his possession.
Patna High Court CR. MISC. No.47941 of 2021(3) dt.26-05-2022 2/2 However, Mr. Raman, learned counsel for the State has pointed out that the petitioner is a habitual offender and is accused in six other cases which have been listed in para-3 of the bail petition.
In response to the aforesaid statement, Mr. Verma, learned senior advocate submits that in one of the cases, final form has been submitted whereas in rest of the cases, the petitioner is on bail. It has also been submitted that those cases span between 2012 to 2019 and precisely for the reason of the criminal record of the petitioner, that he has been named in the F.I.R. as having committed the occurrence.
For the reason aforestated and considering the period of custody of the petitioner which is from 16.01.2021, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Majhaulia P.S. Case No. 08 of 2021.
