Today learned counsel for the State has filed its fourth supplementary counter affidavit stating therein that the accused has been apprehended and as such the order of this Court has been complied with.
In compliance of the earlier order, the Director General of Police, Bihar and the Superintendent of Police, Bhojpur at Ara are personally present in the Court. As the order of this Court has been fully complied with and petitioner, Uma Shankar Mishra is behind the bar, this Court does not want to comment anymore.
However, it is regretted to note here that on earlier three occasions, due to non-compliance of this Court's order, the Superintendent of Police was personally present before this Court and lastly when the personal appearance of the Director
Patna High Court CR. MISC. No.37667 of 2022(13) dt.05-07-2023 2/2 General of Police, Bihar was ordered, the order of this Court has been complied with. I say no more.
The personal appearance of the Director General of Police, Bihar and the Superintendent of Police, Bhojpur at Ara is dispensed with.
As order of this Court has been fully complied with, no further order is required to be passed in the present case. The Trial Court is directed to conclude the trial as early as possible preferably within a period of three months. Accordingly, this application stands disposed of.
