In this case, petitioners are seeking anticipatory bail in connection with Kuchaikote P.S. Case No. 383 of 2019 registered for offence punishable under sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code. Allegation has been made that on 09.11.2019 at about 7:00 A.M., all 16 accused persons came to the house of the informant and started abusing. When the informant raised objection, the accused persons started assaulting causing injury to him by different traditional weapons, such as, Farsa and Lathi. The accused persons also assaulted Nandni Devi, who is
Patna High Court CR. MISC. No.34444 of 2020(2) dt.08-03-2021 2/2 daughter-in-law of the informant, by sharp cutting weapons. When Amrendra came to rescue his wife Nandni Devi, he was also assaulted. Thereafter, the victim was brought to the hospital for treatment.
Looking to the entirety of the matter, this Court is not inclined to grant bail to the petitioners and accordingly their prayer for bail is rejected. However, if the petitioners surrender before the court below, the court below without being prejudiced by this order will take decision in accordance with law.
