The petitioner is apprehending his arrest in a case registered under Sections 363, 365, 366/34 of the Indian Penal Code.

Prosecution allegation, in short, is that the accused persons abducted the daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The victim has already been recovered. On recovery, the statement of the victim has been recorded under

Patna High Court CR. MISC. No.33800 of 2020(3) dt.09-04-2021 2/2 Section 164 Cr.P.C. in which no allegation of sexual or physical assault has been alleged against the petitioner. The date of occurrence is said to be 27.07.2020 for which case was instituted on 30.07.2020. The delay has not been explained by the prosecution.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Kishanganj in connection with Sukhani P.S.
