The petitioner seeks bail in Risiup P.S. Case No. 88 of 2020, registered for the offence under Sections 364, 365, 302, 201, 120(B) of the Indian Penal Code.

As per the F.I.R., this petitioner alongwith other coaccused abducted the informant's son and killed him. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case by the police on mere suspicion. The entire allegation against the petitioner is frivolous and vexatious. Petitioner claims clean antecedent and he is in custody since 18.12.2020. Chargesheet has been submitted.

However, learned A.P.P. for the State opposed the bail

Patna High Court CR. MISC. No.47065 of 2021(3) dt.04-01-2022 2/2 petition and submitted that there is sufficient evidence against this petitioner and the dead-body of deceased was recovered on his confession.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
