JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-06-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420 and some other allied Sections of the Indian Penal Code.
As per the prosecution case, this petitioner is alleged to have sold the land which was registered in the name of informant, his mother and brother.
Learned counsel appearing for the petitioner submits that the dispute is of civil nature and for the same piece of land informant's brother had filed a Title Suit No. 157/2020 in the court of Munsif, Gaya for declaration that the registered power of attorney is unauthorized and fabricated document. Learned counsel appearing for the State opposes the
Patna High Court CR. MISC. No.46894 of 2021(2) dt.21-06-2022 2/2 prayer for anticipatory bail.
Considering the facts of the case and nature of accusation against this petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Civil Lines PS case No. 513/2019, subject to conditions laid down u/s 438(2) of the Cr. P. C.
