=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 09-12-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The present application has been filed seeking provisional bail to the petitioner in connection with Agion (G) P.S. Case No. 26 of 2013 dated 12.03.2013 for offence under Sections 302/307/324/34 of the Indian Penal Code and 27 of the Arms Act.

Earlier the prayer for bail was rejected on 25.06.2014 in Cr. Misc. No. 797 of 2014 but learned counsel for the petitioner submits that in view of the death of his father on 01.12.2015 and the rituals fixed from 11th to 13th of December, 2015, he may be granted provisional bail.

Learned A.P.P. does not oppose.

Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.56026 of 2015 dt.09-12-2015 2/2 case and submissions of learned counsel for the parties, let the petitioner be released on provisional bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned IVth Additional District Judge, Ara in Agion (G) P.S. Case No. 26 of 2013. The petitioner shall surrender before the Court below by 19th December, 2015 and an affidavit enclosing copy of the surrender certificate shall be filed in the present proceeding latest by 22nd December, 2015.

The application stands disposed off in the aforementioned terms.

If the affidavit as directed above is not filed, the office shall place the matter before the Bench for passing appropriate orders.
