JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2019 This is an application for grant of anticipatory bail in connection with Trial No. 3151 of 2019, arising out of Complaint Case No. 549 of 2018, disclosing offences under Sections 354 and 452 of IPC.

As per the complaint case allegation against the petitioner is that he entered inside the house of the complainant and tried to outrage her modesty. On hulla, he fled away, but he identified in the torch light.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case, due to the dispute between the parties with respect to 'Chhajja' and he is ready to abide by any conditions imposed on him. There is no chance to tamper with the evidence.

Patna High Court CR. MISC. No.37296 of 2019(5) dt.20-09-2019 2/2 Heard learned A.P.P. also.

In this case, earlier notice was issued to the opposite party no.2, but it appears from the service report that opposite party no.2 has received the notice, but in spite of that, nobody appears on behalf of opposite party no.2 nor she has appeared personally.

Having heard both sides, in view of the facts, as stated above, the provisional bail granted to the petitioner, vide order dated 19.06.2019 is confirmed.

Accordingly, this application is allowed.
