The petitioner seeks bail in Gurua P.S. Case No.173 of 2017, registered under Sections 385 and 387 of the Indian Penal Code and under Section 17 of the Criminal Law Amendment Act.

The engineer of a power grid company alleged that the criminals demanded extortion of Rs.2,00,000/-. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner surfaced in the case in the confessional statement of co-accused. Similarly situated co-accused, Dhananjay Das has already been granted bail vide order dated 02.06.2020, passed in Cr. Misc. No.12417 of 2020. Of course the petitioner has got criminal antecedents but there is no material against the petitioner in the

Patna High Court CR. MISC. No.34414 of 2020(2) dt.19-01-2021 2/2 present case. Petitioner is in jail since 25.07.2018. Petitioner has already remained in jail for about 21⁄2 years. Considering the facts aforesaid, petitioner, namely, Sunil Yadav @ Sunil Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, Gaya in connection with Gurua P.S. Case No.173 of 2017.
