Petitioner apprehends arrest in registered for the offences punishable under Section 384 of the Indian Penal Code.

As per the prosecution case, petitioner along with other police men have been caught in CCTV footage taking gratification from sand loaded truck.

Learned counsel for the petitioner submits that the petitioner is a member of the Homeguards and at the relevant time, he was accompanying the police party deputed at the site. No truck owner/driver has made any complaint against him. Learned counsel for the State opposes the prayer for bail submitting that the petitioner has been seen in the video

Patna High Court CR. MISC. No.47206 of 2021(3) dt.12-07-2022 2/2 clips to be taking illegal gratification.

Considering the nature of allegation, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
