Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Sahebganj P.S. Case No. 314 of 2021 lodged under Sections 341, 323, 504, 307 and 354/34 of the Indian Penal Code. As per prosecution, F.I.R. has been filed against 2 known accused persons. Allegation against the petitioner is that he reached at the house of the informant and started assaulting the daughter of the informant, in the meantime, the son of the informant reached there. The specific allegation against the petitioner is that he attacked by knife on the son of the
Patna High Court CR. MISC. No.37480 of 2022(2) dt.23-09-2022 2/3 informant, who went to primary health center and thereafter referred to S.K.M.C.H., where treatment is going on. Learned counsel for the petitioner submits that the informant and petitioner, both are co-parceners and pattidar. He further submits that long pending land dispute is going on between both the parties. He has annexed Annexure-2 in the petition by which charge sheet has been submitted by the police. In the said charge sheet it is categorically mentioned that injury report not received. Learned counsel for the petitioner further submits that in the case diary injury report is there but it has been kept reserve. Learned counsel further submits that petitioner has clean antecedent and he is in custody since 30.06.2021. He further submits that charge sheet has already been filed against the present petitioner.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of the case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, West Muzaffarpur in connection with Sahebganj P.S. Case No. 314 of 202, subject to
Patna High Court CR. MISC. No.37480 of 2022(2) dt.23-09-2022 3/3 the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
