JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Earlier a co-ordinate Bench of this court granted privilege of bail to petitioner vide order dated 26.02.2015 passed in Cr. Misc. No. 6680 of 2015 subject to condition that petitioner shall be released after framing of charge but submission on behalf of the petitioner is that petitioner is in jail custody since 09.09.2014 but up till now, charge could not be framed due to non production of other co-accused. It is also pointed out that name of petitioner came in this case in confessional statement of co-

Patna High Court Cr.Misc. No.58316 of 2015 (3) dt.09-03-2016 2/2 accused, Rajesh Bhagat, who has already been granted privilege of bail by a co-ordinate Bench of this court. It is also pointed out by him that earlier petitioner came before this court with a prayer for modification in order dated 26.02.2015 passed in Cr. Misc. No. 6680 of 2015 but this court granted liberty to petitioner to file fresh bail petition before this court.

No doubt, petitioner carries criminal antecedent of several cases but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Khyati Singh, learned Judicial Magistrate 1st Class, Motihari at East Champaran in connection with Pipra P.S. Case No. 14 of 2013.
