Mr.Anand Kishore Choudhary, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 22-09-2023 Pursuant to the order dated 15.09.2023, the Superintendent of Police, Aurangabad is present physically before this Court.

2. A show cause has been filed by the Superintendent of Police, Aurangabad wherein it has been submitted that after examination of all the witnesses, the judgment has been pronounced on 13.09.2023 in Sessions Trial No.184 of 2021, arising out of Rafiganj P.S. Case No.75 of 2021. It has also been submitted that two official witneses, i.e., P.W.7 and P.W.8 have already been examined on 03.08.2023 and 07.08.2023, respectively.

3. It seems due to lack of communication, the aforesaid facts could not have been brought on record before this Court on the last date of hearing, i.e., on 15.09.2023.

4. Under the circumstances, show cause submitted by the Superintendent of Police, Aurangabad is accepted and his personal appearance is dispensed with.

5. The learned APP submits that the judgment has been pronounced in this case and the petitioner has been acquitted.

6. None is present on behalf of the petitioner.

7. Since the petitioner has been acquitted by the learned trial court during the pendency of this petition, the present petition stands disposed of as having become infructuous.
