JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,341,323,324,307 and 504 of the Indian Penal Code.

The prosecution case is that on 27.5.2015 at 10 A.M. the informant was eating in his courtyard, in the meantime, brother of the informant Fate Alam and his wife ( the petitioner) made protest for allowing Md. Julfikar to go from their land. They started assaulting the informant and his wife and when protest was made by the wife she was being assaulted by Md. Fate Alam with lathi. The accused persons took out wheat from the house of the informant.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.9164 of 2016 (2) dt.29-02-2016 2/2 that the accusation has been levelled in the background of land dispute. The accusation of assault is against co accused Fate Alam. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Khagaria in connection with Alauli P.S. Case No.125 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
