JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner seeks bail in a case for the offence punishable under section 304B/34 of the Indian Penal Code. Sonota Devi, the younger sister of the informant was married to petitioner two years ago and due to non-fulfillment of demand of dowry by way of Rs.2,00,000/-, she was tortured and assaulted by the petitioner and other in-law and further the petitioner was having illicit relationship with his Bhabhi resulting altercation and ultimately, the sister of the informant was killed and her dead body was hanged.
Submission is of false implication and that the petitioner was having cordial relation with his wife but she was a

No.56964 of 2015 (4) dt.12-02-2016 2/3 short tamper lady, the petitioner never demanded anything from his wife, the wife of the petitioner sometimes used to quarrel on suspicion and she committed suicide, the doctor has found no external injury on her body and further cause of death has been found due to asphyxia as a result of hanging. The witnesses vide paragraphs 10, 11, 19 and 39 have stated that the wife of the petitioner committed suicide due to suspicion and as such the petitioner deserves sympathetic consideration. The learned A.P.P., after going through the case diary, fairly submits that those witnesses have not supported the prosecution case, but the informant and others have supported the prosecution case.
In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. Ranjan, J.M. 1st Class, Kishanganj in connection with Pothia P.S. Case No.160 of 2015, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on
Patna High Court Cr.Misc. No.56964 of 2015 (4) dt.12-02-2016 3/3 his part without any reason shall disentitle the petitioner from privilege of bail.
