According to prosecution case itself, the alleged recovery of smack and Ganja was made from the house of co-accused Md. Munna and petitioner as well as some other accused were caught in the said house.

Learned counsel for the petitioner submits that coaccused, Mukesh Kumar having similar allegation, has already been granted privilege of bail by a coordinate bench of this court. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S. Case No. 917 of 2015 to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
