The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 149, 323, 325, 341, 504 and 506 of the Indian Penal Code As per the prosecution case, the four named accused persons including the petitioner herein are said to have assaulted Vikash Kumar. Thereafter, it is stated that the nine named accused persons including the petitioner came once again and the petitioner is said to have assaulted Rajendra Prasad by khanti on his head leading to serious injuries. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. There is case and counter case between the parties. The manner of

Patna High Court CR. MISC. No.47313 of 2021(3) dt.23-03-2022 2/2 occurrence is other than what has been narrated in the FIR. The petitioner is in custody since 18.3.2021 and has no criminal antecedent.

The application for bail is opposed by learned APP for the State and learned counsel for the informant. Learned counsel for the informant submits that there is specific allegation against the petitioner in the FIR of having assaulted Rajendra Prasad leading to grievous injuries on his head which would be evident from Annexure-4 to the petition.

Having heard learned counsel for the parties and taking into consideration the facts of the case, contents of the injury report (Annexure-4), petitioner having remained in custody for 1 year and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Sirdalla (Meskaur) P.S. Case no. 293 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-VI, Nawada.
