JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner learned counsel for the informant and learned APP for the State. The petitioner seeks regular bail in connection with Sugauli P.S. Case No. 487 of 2021 registered for the offence under Sections 304(B), 120(B)/34 of the Indian Penal Code. The prosecution story is that the marriage of informant's daughter was solemnized with this petitioner but after marriage he demanded vehicle and cash of Rs. 10 lakhs as a dowry and due to non-fulfillment of dowry demand he used to torture the deceased. It is further alleged that when the informant reached at his daughter's house, he found deceased hanging with ceiling fan thereafter the case has been registered. Patna High Court CR. MISC. No.38387 of 2022(5) dt.03-01-2023 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. It is further submitted that the deceased was in depression as she even after several treatments could not conceive any child, therefore she committed suicide by hanging and this fact shows by Annexed 2 series. The police found the dead body hanging inside room which locked from inside. It is further submitted that there is no earlier complaint of harassment and demand of dowry against this petitioner. It is further submitted that the petitioner is languishing in judicial custody since 27.11.2021.

Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail and submitted that the petitioner is husband of the deceased who was fully responsible to keep and take care of his wife .

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sugauli P.S. Case No. 487 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
