JUSTICE BIRENDRA KUMAR ORAL ORDER 05-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 325, 307, 354, 379, 504, 506/34 and 302 of the Indian Penal Code.

Petitioner no. 1 Deepak Yadav and petitioner no. 3 Vijay Yadav have already been arrested in this case. Hence, their prayer for anticipatory bail is dismissed as infructuous. There is no allegation against petitioner no. 2 Bablu Yadav and petitioner no. 4 Rana Yadav to have caused any injury to anyone at the vital part of the body nor allegation of commission of injury to the deceased.

No.14679 of 2017 (4) dt.05-07-2017 2/2 In the circumstances, petitioner no. 2 Bablu Yadav and petitioner no. 4 Rana Yadav are directed to released on anticipatory bail, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Samastipur/successor Court in connection with Hasanpur Police Station Case No. 106 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner no. 2 and 4 shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner no. 2 and 4.
