JUSTICE SHIVAJI PANDEY ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has challenged the order containing Memo No. 1771 dated 15.10.2008 by which the licence of the petitioner bearing No. 03/90 of P.D.S. shop has been cancelled. It appears that inspection was done and certain irregularities were found, on which the impugned order has been passed in the year 2008 but the petitioner has approached this Court after eight years.

In the aforesaid view of the matter, this Court is not inclined to interfere with the matter as it is completely a dead issue

Patna High Court CWJC No.4468 of 2016 (4) dt.15-03-2017 2/2 and it is not proper for this Court, in such a situation, to exercise its power in favour of the petitioner. However, the petitioner may have liberty to apply for the fresh licence.

With the above observations and directions, this application is disposed of.
