JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 147,148, 149, 341,342, 323, 337, 333, 353, 307, 379, 504, 506 and 120-B of the Indian Penal Code. The allegation against the petitioners is that they attacked on the police force with lathi, danda and bricks. They also snatched the service revolver and mobile from the informant, S.H.O.

It has been submitted on behalf of the petitioners that the petitioners have no criminal antecedent. They have falsely been implicated in the present case. For the same occurrence,

Patna High Court Cr.Misc. No.11132 of 2016 (2) dt.25-04-2016 2/2 separate FIR was instituted. The petitioners have already been granted anticipatory bail in other case. No injury has been attributed against the petitioners. General and omnibus allegation has been made against the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Saba Alam,learned Judicial Magistrate, 1st Class, Katihar in Hasanganj P.S.Case NO. 38 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
