Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as per F.I.R is that

Patna High Court CR. MISC. No.39702 of 2023(2) dt.24-06-2023 2/3 informant had solemnized the love marriage of her daughter with co-accused Prashant Kumar but after some times, she was tortured physically and mentally for demand of dowry. The accused persons threatened to solemnize second marriage of co-accused Prashant Kumar, if demand of dowry is not fulfilled and ultimately they killed the daughter of the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and his name sprang up on the confessional statement of co-accused Saheb Choudhary. There is no eye witness to the occurrence. The petitioner had no concern with the day-to-day affairs of the victim and her husband. The petitioner is languishing in custody since 20.02.2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.39702 of 2023(2) dt.24-06-2023 3/3 (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bakhri P.S. Case No. 36 of 2023.
