Learned counsel for the petitioner has submitted that as the demand shown by the informant had already been paid, therefore, prosecution be directed to enter into compromise after accepting the compounding fee as prescribed under Section 152 of the Indian Electricity Act.
Learned counsel representing South Bihar Power Distribution Company Limited fairly concedes and submits that he will instruct the official to accept the compounding fee and further, enter into compromise.
Patna High Court Cr.Misc. No.23400 of 2016 (02) dt.20-09-2016 Accordingly, instant petition is disposed of under the aforesaid eventualities to be carried out by the respective parties.
